In 1850, John J. appears in the Garrard Co., KY Court to make a statement that only 3 of John's children still live; John J.ca 52, Joseph ca 56 and Moses ca 48; He gives marriage date of John and Nightingale and place of Nigtingale's death. LAND KY06-Census Records list children of John Land and Nightingale(Nee) Land. ****************************************** From Coral Babb <coralbabb@zeus.chapell.com> John Land son of Thomas Land came to Madison Co, Ky c1788 from Pendleton Co, Va. The 1795 Kentucky census showed John Land, James Land and Thomas Land for Madison County. John Land served five terms in the Revolutionary war. He enlisted in Orange County, Va in January or February of 1776. He served as a private in Captain Joseph Spencer's Company, Colonel A. McClannahan's 7th Virginia Regiment and was in the battles of Brunswick, Brandywine and Germantown. He also served in Colonel Heth's Virginia Regiment and the siege of Charleston where he was taken prison at the fall of Charleston and was held for 1 1/2 months until he made his escape and then did not serve again. He stayed in service so long that the time ran out for free land and he purchased land, unseen, in the Poosey Ridge area of Madison County. He purchased 156 acres for the sum of $80. John Land was first given a pension of $8. commencing 12 Mar 1819. He was given arrears to 4 Sept 1819 the amount of $46.39. The semi-anl all'ce ending 4 Mar 1820 was $48. for a total of $94.39. This pension was possible under the Revolutionary claims Act 18th March 1818. He was allowed a pension on 12 Mar 1819. He again asked for help 1821 as he stated that the amount he received was not enough and he had nothing else on which to live. Here he states that he had paid for land that was "uncultivatable." He listed his property as follows: Two horses worth $55.00 One cow and three heifers $20.00 Seven hogs sholts mostly $7.00 Seven or eight sheep $8.00 Poultry $1.00 Farming utensils $4.00 Kitchen furniture $1.50 House furniture besides my bed $3.00 Nothing was due him He owed $1.00 for a hat He could no longer farm, as he had lost the use of his legs, and nearly his speech. His wife Nightingale was age fifty-six and in a low state of health. He lists his children still at home as Moses age seventeen, Elizabeth age sixteen years, Nightingale age fourteen and his grandson William Henry Land age 11. He states that unless he gets help from the government he must, "Come on the county." He was certificate #15412. John Land had married Nightingale Land in Pendleton Co, Va 1789. She was the widow of his brother James Land. She and John Land had five daughters and four sons. John Land died 22 Sept 1846. Nightingale Land went to live in Decatur County, Indiana and died there 17 Nov 1849. ****************************************** WILL OF JOHN LAND: I John Land of the County of Madison & State of Kentucky do hereby make my last will & testament in manner and form following that is to say 1st my desire is that all my just debts be paid out of my estate 2nd after the payment of my debts I give to my wife Nightingale all my lands together with all my personal estate of every description namely all my mechanical tools, all my farming utensils, household & kitchen furniture during her natural life and widowhood and after her death my desires that then all my lands be equally divided into four parts, the personal estate my desire is for it to be equally divided among my five daughters, Frances, Sally, Rosana, Elizabeth, Nightingale except my mechanical tools I give equally to my four sons namely John J. Pond taken at his home in Madison County KY. this 10 Nov 1846 to be read in the County Court of Madison on the question of recording an instrument of writing purporting to be the last will and testament of John Land Dscd. Sworn saith that his health and age are such that he is unable to travel to Richmond. That he knew John Land ?sign will, he was my neighbor. That on the 4 day of August 1826 and at any time in that year said Land was fully competent in mind and memory to make a will. That he has very little recollection of witnessing the paper before him dated 4 August 1826 signed John Land his mark and witnessed by me John Hendron and James Land the two latter witnesses making their mark. But I know that my own name , John Hendron and James Lands are signed in my proper hand write and I was confident that I should I should not have suscribed my name to said instrument as a witness had not John Land been present and acknowledged the instrument, nor would I have ?written the names of J. Hendron and James Land witnesses to said instrument had not they and the testator been both present and requesting it. Hendron is now a very old man and lives in Mercer County, Ky and is not able I suppose to travel to Richmond. James Land lives in Estill and is a son in law of the testator. The body of the will is in George Alcornes hand write, so is John Lands name. Alcorne is dead. And further saith not. The will is sealed to this deposition. So far as where John Hendron & James Land lives I can not state but I have understood that John Hendron lives in Mercer County Ky &? James Land in Estill County Ky. John Hendron is a very old man I can not state whether he is able to ride to Richmond or not. I have understood that George Alcorn was dead but I do not know the certainty of it. I understood that James Land was a son-in-law of John Land Decd. I also understood that his wife was dead but I do not know the certainty of it. Joseph R. Pond The foregoing deposition was this day taken, subscribed and sworn to before the undersigned and acting Justice of the Peace in and for Madison County Ky at the same time and place and for the purpose stated in the caption. Given under my hand this November 10th day 1846. He was born on the Pedee River in North Carolina, in 1760. He volunteered into service in Fairfield District South Carolina.
