Joseph PAYNE1 was born in 1720 in Bedford Co., Va. He died in 1803 in Bedford Co., Va. Joseph resided in Bedford County during the Revolutionary war and while here he furnished the Commonwealth of Virginia with 400 pounds of beef. For this patriotic service he was awarded 415 acres of land 4 Jan 1796. (These transactions present a puzzle because of their sequence and quantities. It appears the same land is entered in 1770, 1775 partially sold {238 acres} in 1777 and then given to Joseph again in 1796, obviously we've missed other documents or there were several different tracts involved.)

The Joseph PAYNE Family
of
Virginia, Tennessee and Mississippi
Other publications discuss the Payne's of Virginia and their descendants in Tennessee, but some of the interesting information that tells of individuals in another line has been left out. This section presents certain data and opinions regarding Paynes in the Joseph and Phoebe Payne line. This line has not been connected to Payne families of Virginia prior to Joseph who was probably born in Virginia about 1720 -1730. The first record of this man is for a land transaction in Bedford County, Virginia in 1760. One son, John, states that he was born in Bedford County March 17, 1754.
"Old Joseph" Payne who was said to have given "2 beeves weight 400" to the continental army, was paid quite well for his "gift." He received 24 shillings per pound and 415 acres of land for this "gift." He supposedly did not believe in writing wills, because his oldest friend, Micajah Walker, said:
"I was raised from a child with Joseph Payne and I have heard him say that he wood never will anything to his son James and he said that after he was dead the children might fight it out."

The will given below was contested, overturned for a period of time and then reinstituted. It reads as follows:
In the name of God Amen, I Joseph Payne of Bedford County and State of Virginia being weak in body but of sound and perfect mind and memory, blessed be an Almighty God for the same do make and publish this my last will and testament in the manner and form following, that is to say. First I give and bequeath to my sons Thomas Payne, Joseph Payne, John Payne, Obadiah Payne, James Payne and Barnett Payne the sum of one dollar a piece. I also give and bequeath to my daughters Lucy Stanley, Betsey Crabtree, Susannah Slinker, Nancy Brown, Dicey Brown married women the sum of one dollar a piece, which said several legacies or sums of money I will and order shall be paid to the said respective legacies within six months after my decease. I furthur give and devise to my said son James Payne, his heirs and assigns all the land that I possess, situated, lying and being in the County and State aforesaid on the waters of Stanton River, forever with all and every of its appertenances with all my personal estate, livestock, goods and chattles of what kind and nature soever - And I do hereby appoint my said son James Payne sole executor to this my last will and testament, hereby revoking all forms and wills by me made. In witness whereof I have hereunto set my hand and seal this twenty seventh day of June in the year of our Lord one thousand eight hundred and three.

Other people, such as John Woodcock, also believed the will to be invalid. His statement reads:
I John Woodcock of Franklin County now in Bedford County came to old Joseph Paynes to talk with him respecting making a will and to leave his son James some more than the rest of the children because James had had the trouble of him in his sickness and the old man answered and said he would make no will, that his children would all come in for one equal part.

Millie Slinker's statement goes even farther by saying:
I Milly Slinker of Bedford County have been living with Joseph Payne seven or eight years and do not believe that the old man had the full exercise of his reason during the last illness - one day in the time of his illness I heard his son Barnard Payne read a note of hand to him and the old man said he did not know what it was he was reading to him and that Barnard could not make him understand it and I frequently heard the old man say with an oath that he would never make a will not withstanding his son James and old James Johnson had often persuaded him to make one, for he chose his children all to have an equal part of his estate for that James was not so good to his mother that he should will it all to him.

John Martin confirmed her feelings:
I John Martin of Bedford County was frequently with Joseph Payne in his last illness for the purpose of nursing and waiting on the old man and do not believe that he was in his proper and full understanding during the time I waited which was till his death as often as once or twice a week and sometimes oftener both before and after he made his will. In this time I frequently observed the old man as in the art of rubbing tobacco and then filling his pipe when he had neither pipe nor tobacco in his hand.

In Book 13, page 79 of Bedford County, Virginia, we see that the court agreed on Feb. 27, 1804 that Joseph was "not of sound disposing mind and memory and that there was apparent fraud and that the said will ought not to be admitted to record." The District Court, however, on "16th April 1805," said:
The court having maturely considered the evidence and arguments of counsels are of opinion that the order aforesaid is erroneous. Therefore it is considered that the same be reversed and annulled and that theappellant recover against the appellees his cost by him expended in the prosecution of his appeal aforesaid here.

So, James got the land plus the rest of the estate, which was itemized and appraised at 34 pounds, 15 shillings, and 6 farthings. This included 5 cows and calves, 2 heiffers, and 3 bulls, in addition to farm implements and household furniture.

The testimony of Millie Slinker mentions "Barnard" Payne. This is most likely a transcription error, as Joseph had a son named Barnett, but no Barnards are in the family or the area. Barnett is a recurring first name for Payne men. The first one I have found appears in the early 1720's, in Spotsylvania County, Virginia. As Barnett Payne, Sr. he is the administrator of the estate of Barnett Payne, Jr. who died in 1740(?). Some researchers conjecture that this Jr. was the father of "old Joseph" as he also had a son Barnett, who died in 1845. There seems to be a fourth Barnet Payne who was murdered in 1793 in Halifax County, Virginia. The documentation for this needs further investigation, and should include more about the Barnet Pain mentioned below.

To his Excellency Gov. Lee:
A certain Murder having been committed by a certain Rich'd Adams, of the county of Halifax, on the Body of Pain, and the coroner appearing with his Jury, did find the said Pain murdered, and sundry witnesses being called on did then Declare that the said Rich'd Adams did commit the murder aforesaid, upon which the said Adams amediately fled and some time after was taken by his father and carryed before a Magistrate without any of the witnesses aforesaid that saw him commit the said murder; and was by the Justice acquitted, and when this artcial tryal was discovered, three of the Justices sent out another warrant to bring him to a fair Tryal, but he amediately fled into the State of North Carolina, * * * and armed to the terer of the people, and will not be taken nor come to Justice. I hope therefore such proceedings may be had by your honorable council as will force the said Adams to a tryall by offering a Reward or otherwise as you shall think proper, for I can assure y'r Excellency the people are alarmed at such notorious offenders escaping unpunished.

Richard Adams, who is accused of the murder of Barnet Pain, late of Halifax county, is considered as a worthless Dangerous man by the people and has avoided many attempts made to apprehend him. I vouch for the truth of every article set forth in my former letter and shall send down to you all the papers and the Coroner's Inquest.

Was this Barnett Payne related to Joseph?

By the time "old Joseph" died in 1804, John and Joseph, two of his sons, were already in Sumner County, Tennessee. There they raised large families and prospered as pioneers in the region south of the Cumberland. Another son, Obediah, settled in Knox County, Kentucky after his accusation of being a horse thief in Virginia.

This was not the only Payne who appears in court records for something other than a will or deed. In Sumner County Court Records for 1815-1817, we find this for November, 1816.

The State vs Simpson Payne (son of John)

The said Simpson Payne who stands charged according to law with being the reputed father of a bastard child of which Nancy Briley has lately been delivered came into court and paid six dollars and 25 cents for fines imposed by law for the offence or crime of fornication and together with Edgar Douglas and John Cotton has acknowledged their bond to the Justice in the penalty of five hundred dollars conditioned as the law directs for the birth, maintenance and bringing up of the child.

This was the same Simpson Payne who had served as a second lieutenant in the War of 1812. Less than a year after this court appearance, on 13 October 1816, Simpson married Elizabeth Greer. She died, probably at the birth of her first child, presumed to be Susan, and later when Simpson married Elizabeth Turner, he kept in touch with the Greers, and even seemed to follow them on his trek to Mississippi. Listed "among the early settlers" of Marshall County, Mississippi were "James Greer and Robert S. Greer, who represented the county in both branches fo the Legislature." The History of Mississippi, by Lowry and McGardle, published 1891, from which this is taken, mentions only 6 early settlers around Wall Hill and Watson. They were Wm. Wall, John Sharp, Levi Fowler, Harvey Nichols, Simpson Payne and Isaac McCampbell.

The following notes are in a booklet published in 1936 which states it is "Volume I. History of Marshall County. Published by the Garden Club every Hundred Years. 1836-1936."
Wall Hill -
Wall Hill was founded about 1820 or 25 by a Mr. Billie Wall. It was located on a hill and called Wall Hill. About 1875, Wall Hill was a flourishing and prosperous community with four stores doing a big business, churches and schools. But today nothing is left but memories of a once thriving community.

Holly Springs Bar -
It is probable that Holly Springs has furnished more judges than any other city of comparable size in the state. In addition to those already named, there were ....Judge James M. Greer.

From other records we know that Simpson's daughter, Susan, married Thomas Payne in Sumner County, Tennessee 3 November, 1834. Then she divorced him in Holly Springs, Mississippi 13 January, 1842. The divorce abstract reads:
Bill for Divorce - Susan S. Payne, by her next friend, Robert S. Greer - vs.- Thomas J. Payne.

Susan's middle initial, S, was supposedly for Searcy, and might also have been the middle name of Robert S. Greer. The name Searcy follows both Paynes and Greers. Jerry Wilson's book, Joseph and Phoebe Payne Family, states on page 87, "He (Simpson) was married at least twice, first in Sumner County 13 October 1817 to Elizabeth Searcy Greer. She was born 27 November 1799 to James Greer, Jr. and Susannah Searcy, she died 4 October 1819."

The Thomas J. Payne who married Susan S. Payne was probably a cousin, possibly the son of Gideon, son of Joseph, brother of John. This Thomas J. later married Elizabeth Roney on 14 June 1842 in Robertson County, Tennessee. He was 28 at the time, and could easily have married Susan before that. Parents: Barnett PAYNE Jr. and Ann HASKEW.

A paper purporting to be the last Will and Testament of Jo Payne was this
day introduced in court and proven by the oath of John Riley, Sr. and
Henry Martin by their _____ witness then to and ordered of record as

In the name of god Amen, I Joseph Payne of the County of Knox and the
state of Kentucky being of sound mind and disposing memory for which I
think god and calling to mind the uncertainty of human life and being
desired to dispose of all such worldly estate as I hath pleased god to
___ use with I give and bequeath the same in the manner following _____.
1st I desire that all of the perishable part of my Estate be sold after


my decease and out of the moneys amassing there from all my just debts
and funeral expenses paid.
2nd I give and bequeath to my wife Jane Payne personal and real estate I

sales of my Personal Estate after the debts and funeral expenses are paid
as above to be used during her natural life for the maintenance of

Franklin Payne all the real estate I may have or hold any claim to at my
death to be equally divided between my five sons above named for their

4th To my daughters-Nancy Coleman?, Rachel Hignite, Mary Hughes, Eliza
Bain, Agnes Parrot?, Amanda Randels?, Joanna Berry, Lucy Sampson,
Elizabeth Laws?, Telitha Broughton, and Lydia Payne, I desire my five
sons above named to pay one of my daughters named in this will the sum of
ten dollars where the property bequeathed same shall pass unto their
hands after the death of my wife Jane Payne.
5th All of the rest of my estate both real and personal

Obadiah PAYNE1 was born in 1756 in Bedford Co., Va. He died in Fighting Creek, Knox Co., KY. Note:
In the year 1773 he and his brother in law, Richard Oney were among the first settlers in the Deskins Valley area of Tazwell County, Virginia. In 1780 he was charged with a felony in Bedford County,
Virginia. The complainant alleging that he had taken a horse and some other property. This was one of several court cases that involved Obediah Payne between 1780 and 1797 in the State of Virginia. In Russell County, Virginia on Nov 2 1781 there was an entry made in Land Entry Book One, page 53, for 150 acres on the Clinch River, Tazwell County for Obediah Payne. This was part of Treasury Warrant #7844 and is mentioned in Benjamin Oney's will in Tazwell County Virginia. It is believed that Obediah Payne left the Russell County area about 1797 or shortly thereafter and went to Knox
County, Kentucky. He was definitely in Knox County in 1800 as he received a bounty for a wolf scalp sold there. Obediah left no will when he died in 1818 and he is buried at the Martin Cemetery on the
Old Payne Martin Place, Bimble Hinkle Road in Knox County, Kentucky. Only an unmarked stone however marks his burial place. His wife Jemima died about 1820 and is buried there also. Some of the known children of Obediah and Jemima Payne are - Elijah, Elisha, Thomas and Benjamin Oney Payne. Joseph and William Payne were also their children as well as others.
