Smith b: ABT. 1848 in Missouri Staunton Smith b: ABT. 1852 in Missouri Parents: Benjamin COLVIN Sr. and Nancy P. COLEMAN. Spouse: Staunton SMITH. Staunton SMITH and Anna COLVIN were married about 1837. Benjamin COLVIN Sr.1 was born on 7 Jan 1759. He died in Dec 1837 in Boone Co., MO. Benjamin Colvin was born 1-7-1759 and died 12-1837 in Boone Co., MO. He 2nd married Nancy Coleman on 12-11-1793 in Culpeper Co., VA. Nancy was born 1770-1780 and died after 1841. She was likely the daughter of Ambrose Coleman and she is listed as one of the contributors to the establishment of the University of Missouri in 1839. Benjamin served in the Revolutionary War (enlisted on 4-7-1778) as a private in the companies of Capt. Elijah Kirtley and Capt. Samuel Ferguson. He served under a Colonel John Willis' Virginia regiment. Total length of service was nine months and ten days. He was in the battles of "Hotwater" and Jamestown. During the Battle of Jamestown, 26 Americans lost their lives, 99 were wounded, and 12 were missing in action. The British, under General Cornwallis, lost five and 70 were wounded. Benjamin enlisted 4-1778 while a resident of Culpeper Co., VA. He applied for his revolutionary war pension in 6-1832 while a resident of Boone Co., MO. His pension was granted on 9-28-1833 in the amount of $33.11 annually. His application is recorded in Book 3, Vo. 8, p. 80, by William R. Palmer, clerk. Benjamin was able to read and write and his application does bear his signature. Said application may be found in the appendix of this document. Benjamin is listed as paying taxes in Virginia between 1782 & 1787. Benjamin and family appear in the 1810 census of Culpeper Co., Va. A certain Henry Stringfellow mentions Benjamin in his LWT (dated 9-21-1814 and proved 2-20-1815). Mr. Stringfellow bequeathed "to Benjamin Colvin the house he now lives in for as long as he wished to live in it; one negro woman named Doll and all her increase, one 80 gallon still with cap and worm." Mr. Stringfellow also mentions Benjamin's sister, Nancy Camp, in his LWT. He directed that Benjamin should pay her "five pounds a year for four years to clothe her and her children." He further left to Lucinda Colvin, daughter of Benjamin Colvin, "one dozen silver spoons and one trunk." Executors of this LWT were Benjamin Colvin and James Tutt. It was witnessed by Richard Ellzey Tutt, John Horner Jr., Nelson Whitehead, and Willis Camp. Benjamin Colvin appears in the 1830 census of Boone Co., page 124, living in the township of "Cedar." His LWT is dated 7-21-1835 in Boone Co., MO. In his LWT, Benjamin mentions his children....namely, Jeremiah, John, Henry, Katherine, Anne, Elizabeth, Ambrose, Madison, Garland, Benjamin, and Lucinda. He also mentions his wife Nancy. This LWT is probated 1-3-1838. _______________________________________________________ COLVIN info from Marilyn Solari via Lu Smith: Benjamin Colvin b 7 Jan 1759 Va. d Dec 1837 Boone Co., Mo. (apparently unmarked grave SOMEPLACE!) m #1 abt 1780 m#2 12 Dec 1793 Culpeper Co., Va. bk 1:29- Nancy Coleman Banjamin served during the Rev. War as a private, enlisting on 28 Apr 1778 in Culpeper CO., Va. (where he then resided) in a company commanded by Capt. Elijah Kirtley of Sulpeper Co., under the command of Col. John Willis of Hanover, Va., for a period of six months. At the expiration of this term, Benjamin joined Capt Ferguson's company for 3 months. (Ref. Pension Bureau Rec., Pension S.16,727-Benjamin's deposition June 1832, age 74 years, resident of Boone Co., Mo.) Benjamin appears on a list of tithables in Culpeper Co., Va. dated 4 May 1787 with 1 tithe and 3 cows, District fo Daniel Brown; and again in 1800 with 2 white tithes and 3 horses. District of Daniel Brown. Benjamin is named as an heir fo John Colvin, dec'd, and wife Margaret (Day) Colvin in Culpeper CO., Va. deed (Bk S:78) dated 14 Sept 1794. However, it is this compiler's belief that he was so named as the surviving parent of minor children , having been married first to a dec'd daughter of John and Margaret's. No wife signs with Benjamin despite the fact that he had married Nancy Coleman the year before, and proof exists that Benjamin did indeed haave three sons born before his marriage to Nancy, bolstered by the statement of Harriet (Colvin) Gordon, granddaughter of Benjamin Colvin, that her father, Benjamin, Jr., had half-brothers. In the 1810 census of Culpeper Co., Va. (pg 86, line 15) Benjamin Colvin's household contained 5 males under age 10, 1 male 10 0 16, 1 male over 45, 1 female 10 to 16, and 1 female 26 to 45. On 16 June 1813 Culpeper CO., Va. the will of James Tutt was proved, one of the witnesses to this will being Benjamin Colvin. Benjamin was named as one fo the heirs of Henry Stringfellow of Bromfield Parish, Culpeper CO., Va. in his will dated 21 Sept 1813 (proved 20 Feb 1815 to whom Stringellow left the house he (Benjamin) now lives in for as long as he wishes to live in it; 1 negro woman named Doll and all her increase; one 80 gal. still with cap and worm. Stringfellow further instructed Benjamin to pay Nancy Camp, sister of Benjamin, 5# per year for 4 years to clothe her and her children. And to Lucinda Colvin, daughter of Benjamin, he left 1 dozen silver spoons and 1 trunk. Benjamin Colvin and James Tutt were named as executors, one of the witnesses being Willis Camp who married Nancy Colvin in 1798 in Culpeper CO., Va. On 16 April 1819, Superior Corut of Chancery, Fredericksburg, Va, Dist. records the answer of Benjamin Colvin to a Bill of Complaint against him and others by Henry Stringfellow (nephew of Henry who died 1815) and others. Benjamin Colvin as acting executor of the will of Henry Stringfellow, granted a power of attorney to James Tutt (his son-in-law) on 28 May 1819. On 20 Jan 1820, Ambrose Colvin (son of Benjamin) deposed regarding the above suit, the file on the case also contained a notice to Benjamin Colvin and his securities marked Benj. Colvin removed to Ky. & copy left with James Tutt, his agent 15 Nov. 1819. However, Benjamin does not appear in the 1820 Ky cnesus index so it is apparent he did not tarry in that state but went directly to Mo. Benjamin's will dated 21 July 1835 (Boone co., Mo. Probate file # 427) named first my sons Jeremiah, John and Henry Colvin ($5.00 each), then named as equal heirs (after the death of his wife) my following children to wit: Ambrose, Madison, Garland, Benjamine, Lucinda, Elisabeth, Katherine and Anne. he named as executors his sons Madison and Ambrose. His will was rpoved on 3 Jan 1838 but executorship of the will was not granted until 5 Aug 1841, probably instigated by the remarriage of Benjamin's widow, Nancy in Jan of that year.. Wife #1 ? Died: abt 1790/1791 prob in Culpeper CO., Va. Father- Prob John Colvin? Mother: Prob Margaret Day? It is believed by this compiler that Benjamin's first wife was a deceased daughter of John & Margaret (Day) Colvin, and the mother of Benjamin's three eldest children. Benjamin was named as one of the heirs of John Colvin in 1794, no doubt representing his three minor children who would therefore be grandchildren of John Colvin's and legal heirs. It is interesting to note that John Colvin left minor children who were not named in the deed selling his property because of their minority. Henry Colvin was also named as an heir and it is known that he had a first wife, Susannah Colvin, who was deceased by 1787 when Henry married a second time (his 2nd wife also not signing the 1794 deed with Henry). This compiler also does not consider Henry Colvin to be a son of John and Margaret but the former husband of their decaused daughter and father of her children who were legal heirs and grandchildren of John & Margaret Colvin. Wife #2 Nancy Coleman b 1770-1780 (age 60 to 70 in 1840 census) died after 20 May 1845 prob Boone Co., Mo. Father: prob Ambrose Coleman; Mother ? Notes: Muriel E. Lewis found a notation in Culpeper CO., Va. Minute Book 8 pg 225, corut session of 21 Aug 1814, regarding the will of Ambrose Coleman. Madison Coleman ^ Benj. Colvin, two of the exors named in said will came into court & refused to take upon themselves the execution of the said will (James Coleman appt. exr; note-- this will is "missing") Since Nancy named her first born child and son Ambrose, it is highly likely that the above Ambrose Coleman was her father although this is as yet unproven. At the death of Benjamin, his will bequeathed Nancy all real & personal estate for her natural lifetime, $500. of said property to be her absolute property to dispose of as she pleases. Nancy md 2nd 26 Jan 1841 James Cunningham in Boone CO., Mo. Nancy was still living in May of 1845 when as Nancy Cunningham, she was a pruchaser fo the estate sale of Benjamin W. Colvin (son of Nancy's step-son, John Colvin). _______________________________________________________ Name: Benjamin Colvin , Sr. Sex: M Birth: 1758 in Culpeper County, Virginia Death: DEC 1837 in Boone County, Missouri Veteran of the American Revolution.
