Woodson Clerk (p. 146) This Indenture made this tenth day of September in the year of our Lord one thousand eight hundred between Jerusha Farris widow of Isaac Farris deceased and James Bird and Susanna his wife John Thomas Farris, Elizabeth Farris, George Washington Farris, Wilmoth Farris, and Isaac Farris infant heirs and representatives of the said Isaac Farris deceased of the county of Lincoln by Archibald Dickerson, Peter Trisler, James Dunn, commissioners by and on the part of said infants appointed by the county court of Jessamine County in the month of March 1800 and John Bowman of the county of Mercer and state of Kentucky of the one part and Thomas Nicholson of the county of Jessamine and state aforesaid of the other part Witnessed, that whereas by an act of assembly passed on the first day of March 1797 entitled an act to reduce into one - the several acts for the conveyance and division of Lands it is provided that where any person shall die in testate [ ] leaving his heirs or any of them infants and having before his death executed a bond [ ] binding himself to convey any tract or parcel of land that in such case the court of the county wherein the land shall lie shall have power on the application of the person to whom such bond is given to appoint three fit persons as commissioners who will in conjunction with the other heirs above twenty one years shall have full power and authority to convey such - tract or parcel of land agreeably to the tenor of such bond, and whereas Isaac Farris did with Nathan Farris his security on the fourth day of September 1786 executed a bond in the penalty of three hundred pounds conditioned for the conveyance of three hundred acres of land laying in the (p. 147) then county of Fayette, now Jessamine, on the Jessamine Creek which bond is now of record in the county of Jessamine county reference being had thereto will more fully appear the said Isaac Farris afterwards departed this life not having made this said conveyance and leaving the said Jerusha Farris his widow, the said James Bird husband of the said Susannah, daughter of the said Isaac now of the age of twenty one, and the said John Thomas Farris Elizabeth Farris George Washington Farris Wilmoth Farris and Isaac Farris his children infants under the age of twenty one, and on the application of the said Thomas Nicholson to the county court aforesaid the said Archibald Dickerson Peter Trisler and James Dunn were appointed commissioners according to the before recited act on the part of the said infant heirs of the said Isaac Farris deceased to make conveyance in conjunction with the heirs who are of full age to Thomas Nicholson of the said three hundred acres of land according to the tenor of the said bond. Woodson (p. 157) This indenture made the twentieth day of January in the year of our Lord eighteen hundred and one between Andrew Crockett of the county of Wythe and state of Virginia of the one part and Nathaniel Drake of the county of Jessmaine and state of Kentucky of the other part witnessed that the said Andrew Crockett for and in consideration of the sum of two hundred pounds current money of Kentucky to him in hand paid the receipt whereof he doth hereby acknowledge hath granted bargained and sold and by these presents doth grant bargain sell alien and confirm unto - the said Nathaniel Drake all his title to a certain tract or parcel of land situate lying and being in the county of Jessamine and state aforesaid bounded as follows, to wit, Beginning at a black walnut and hackberry tree on a ridge the west side of Jessamine Creek and running thence north ten degrees west three hundred and forty poles to a honey locust, oak and ash trees thence north seventy east one hundred and twenty poles to a walnut elm and ash on the old trace thence south seventy east twenty three poles crossing Curds road at 168 poles to three white oaks hickory ash and honey locust thence south twenty west three hundred and twenty poles running S. 20. W. 440 poles (p. 158) to the beginning containing five hundred acres together with all and singular the premises aforesaid with the appurtenances and privileges thereunto belonging or in anywise appertaining to have and to hold the said tract of land situated as aforesaid unto the said Nathaniel Drake his heirs and assigns forever and the said Andrew Crockett for himself and his heirs doth covenant and agree with the said Nathaniel Drake that he will forever warrant and defend his title only to the aforesaid tract or parcel of land against himself and his heirs and against all persons claiming under them and it is to be further understood that the said Andrew Crockett or his heirs are not to be answerable to the aforesaid Nathaniel Drake or his heirs for any part of the purchase money in case the land in this deed or any part thereof is taken by any prior or better claim as this being particularly mentioned and specified in their contract and about the premises aforesaid.
